Epson Settles Empty Inkjet Cartridge Lawsuit
Epson will give out a $45 credit to consumers to settle class-action lawsuits filed against them in California, Texas and New York. The lawsuits argued that a “substantial” amount of ink remained in Epson inkjet cartridges at the time that the printer indicated the cartridge was empty. The settlement applies to anyone who purchased an Epson inkjet printer between April 8, 1999 and May 8, 2006. The $45 credit is for use at Epson’s online store, and can be used on printers, inkjet cartridges or any other products. Also, instead of the $45 credit consumers can choose to receive a $25 check from Epson and a $20 credit for their store, or else a 25% discount ($100 is the max discount) off products at the Epson store.
Now in our opinion, this settlement is kind of lousy. This has always been a big complaint of our customers who use Epson printers and they find it pretty annoying that their printer will basically stop working because it says a cartridge is empty, even though it usually isn’t. Under the terms of the settlement, Epson admits no wrongdoing and will not change any of their technology. They will change their packaging to note that “empty” cartridges are going to still have some ink in them. So the lawyers get their big cut, Epson can say they did nothing wrong, and consumers are left with a credit from a company they may never want to buy from again. It could even prove to be a gain for Epson, if consumers use the $45 credit and then spend additional money or if they elect to take the 25% discount. What is supposed to be a penalty for them could turn into a flood of traffic for their online store.
On a positive note, the settlement is pretty large and the process to claim it does not seem that difficult. This is not the usual class-action settlement where you have to fill out five forms to get your $2 share of the loot. If you registered your printer with Epson, then you will automatically receive the credit. If you haven’t, you can go to http://www.epsonsettlement.com/ and find the claim form there.
The last day to send in a claim form is June 22, 2006.

Update 5/30 - Ron, one of our commenters, left this note: “I got this back from Epson about the e-store code: Per this website, the settlement benefits are not distributed until AFTER the court considers final approval on the settlement. The settlement benefits will be available no sooner than the late fall of 2006. Thus, any Epson Store codes will not be activated until after the final settlement.”
This would explain why a lot of people have been wondering about actually using their benefits at the Epson store.
Update 6/1 - Another commenter, Jerry, pointed out this link: E-Store Code Notification. So if you sign up, you will be automatically notified via email or postcard that your code/benefits are ready.
Update 9/18 - The latest news on this case is that the settlement was officially accepted by the Court back on August 15th, so this should mean that everyone’s E-Store codes are valid. If you are still having trouble, you can always try calling 1-877-506-4031, which was a number set up for all class members. There is a pretty long recording that you have to listen to at first, but you could always try hitting 0 to see if an operator appears.

We must remember the settlement may not be much to you and I, but we must remember, how else are you going to get your satisfaction of going after these rip-off artists. So the lawyers get the money. This allows them to go after those other crooks. I say, where would you be if there was no one to represent you? You would be out-of-luck! That million dollar company won.

I HAVE THREE EPSON PRINTERS A 925,200 AND 220 LOVE THE SERVICE OF THE PRINTERS. Ink is high and the printers will stop when the ink gets low, not all the way out. That is a bad thing, I used a lot of ink.

I too have my e store code, no place to enter it, no one to contact wow DO I FEEL GOOD ABOUT THIS SETTLEMENT NOT.
At least I got an all in one so I can still scan. A friend liked the quaility, so we bought one too. I just bought new ink but my screen went out so I can’t even replace the cartriges that are likely not empty anyway!

Is it possible to return the printer for a credit for a new one, not HP or epson?? Why would I want a $45 credit, for me to use it legally says that I agree with it and I don’t. My husband went out and replaced 6 cartridges for $86. What is $45 for?? One black and one yellow??
Sorry, but I will not be purchasing an epson in the future, I want flexibility not constraints with my products i purchase.

Frankly I feel that it is not right and unfair that Epson manipulates consumers to use only their products… for profit. I recently spent a lot of money on ink, only to find that there were defects, due to their “precious” Intellidge chip. My ink level readings were false and I say this because I bought two sets within two days. Because of this mishap, it has slowed down progress for my printing business. Thanks to you Epson, you lost another customer! I’ll never buy your products again! I wouldn’t even refer you to my worst enemy.

Epson should — at least — update their printer driver and make it available so that the printer will continue trying to work. What they did, I believe, is make sure that the jets need cleaning just when one of the four colors is low. Then, when you say, “OK, clean them,” the software says, “Not enough ink to clean cartridges! Replace now or live with poor quality, SUCKER!! Ha ha ha!” When it works, it works well, but I will never buy any Epson product again! And I refuse to buy their ink.

In the notice mailed out about this settlement, it says you can go to www.epsonsettlement.com and sign up to be notified when the benefits are activated. They will either notifiy you be e-mail or postcard, your choice. We’ll have to wait to actually use our settlement, but at least we can get a reminder when they finally activate the code at the Epson store. I wonder how many people they are banking on to just forget about it…?

I never got anything in the mail about this. I registed my printer not long after I got it this past Christmas but I just now found out about the lawsuit. Why didn’t I get anything in the mail? Is there any way for me to claim my $45 now?

If you received an E-Store Code with the claims booklet does that mean you are already registered? I trashed the printer and the papers it came with and can’t remember if I registered it after I bought it. Worst printer I ever owned. Had to be cleaned constantly because it plugged up and ink cartridges ran out - supposedly - after minimal use.

To Jerry’s point, Epson’s strategy is clearly to ensure as few “customers” as possible redeem the code. My claims booklet arrived in the mail, coincidentally with a similar class-action document from a hotel chain. As a designer who’s had some experience with direct mail it was quite obvious that both were created to look like junk mail. Step 1: get people to just throw it away.
Well I kept it, and somehow managed not to lose the indistinct white paper amidst bills and office work. Step 2 offer a potentially better deal, contingent on a larger purchase at Epson’s E-store that requires a special deadline-driven registration. Few probably understood it or took advantage opting for the simple E-Store coupon.
Step 3, assuming that the code included in the mailing actually meant something, I didn’t appeciate until I tried to redeem it that it was not yet active. Since arguably I was letting them off the hook by accepting the lesser $45 offer, I didn’t expect to have to wait months longer (possibly losing the paper and code in the process). I signed up for email notification when the code is activated. We’ll see if Epson follows through on that front; perhaps the email will be designed to look like spam!
I like my Epson printers (2200 & 4800). I have spent a small fortune on Epson ink and paper. I have no intention of getting rid of them and that’s why Epson’s calculated and cynical strategy in this matter is very disappointing. Instead of making me feel they’ve done the right thing for a loyal customer, they’ve frustrated and annoyed me unecessarily. Not a smart move in a device/consumables market that moves as quickly as inkjet printing. Epson… you blew it.
Oh, and the hotel chain credit for $3… I threw it away.

I don’t completely understand the reason why Epson initiated this program either, however, the ink left in the cartridge is a necessary part of the technology and I do understand that part. As far as I am concerned, Epson makes great printers and they make money from ink cartridges and not the $69 printer that I bought. The sooner that we all understand this, the more that this whole $45 credit strategy will begin to make sense. Smooth move Epson!! I love your printers too!!

I have 3 “THREE” Epson printers. My latest being the Stylus Photo R300. Nice printer! The bad thing is I have the single cartridges. It takes 6 cartridges which was supposed to save money by replacing only the color needed each time instead of tossing out the color cartridge full of unused inks, like my older stylus photo.
I have a printer that tells me I’m out of ink when I’m down about 1/4 to 1/3. I have a box full of near full cartridges. I must have got their best printer! Thanks Epson! You’ll never get my business again! I’ll be spreading the word!

I just opened this mailer with my code. DOes anyone know what this code is for and am I to late for the three other printers that I received nothing and especially no code. In regards to the last question. I recently saw on e-bay a device that reprograms the computer chips that are on the epson printer cartrdges. The main reason they use these chips is so people would not refill them Now you can buy this device that reprograms the chip on each cartidge. You basacily fool the printer into thinking you have more ink until you run dry. Another comment I have is that there are other devices out there today that allow you to have huge containers of ink that flow into your cartridges the only problem I have had with these devices is air bubbles. You have to clean the heads all the time to keep them full. I love my epson printers especially over the HP but I can’t figure out why they have to change the ink cartridges so often and not make them more universal for all their printers.After 8 months walkmart no longer sells my epson cartriges whats the deal with that when epson makes 90% of there money from ink and not the devices themselves.

I wasn’t going to comment any further, but what the heck! My cx5400, all in one, is the best printer i have ever had. I absolutely love it. The quality is second to none. But…. I am extremely ill about the fact that the printer shuts down when a cartridge is empty, or not. So, guess I’ll probably go with another brand on my next purchase.

I have an R1800 and just replaced two of the cartridges. I guess they weren’t empty as I find out when my wife came in and tells me abut the mail from Epson.

Oct. 22: I just tried my E-Store code with no success. The only thing I could think of to order with my $45 credit was photopaper. Once I upgrade my computer system (hopefully in the near future) I will never buy Epson again. I too think this type of settlement is a farce.

I have tried several times to redeem the code I received in the mail to no avail. I also registered another printer 3 months ago to which I have received no response from Epson yet. I do like my Epson printer…however, in light of all this garbage I doubt I could ever recommend anyone buy an Epson printer nor would I again. I think from here on out I will go with HP only.

Remember, you can STILL register with Epson and get the credit– you have until November 13, 2006 to do so.
That’s good news for people who lost the form or didn’t get it in. It pays to read the fine print in the Agreement for this little extra allowance.
Be sure to print out the registration form so Epson doesn’t “forget.”

I have my Epson cartridges refilled at Island Ink-Jet kiosk, at Broward Mall (FL). If anyone has that franchised store in their neck of the woods, it is worth a try. They also do other brands.
They fill the cartridge, and reset the chip on the tank; for about 1/2 the price of the Epson brand. I think they last longer because this company fills them to top capacity; not the Epson skimpy supply. The ink is a perfect match to the brand name, and the tanks can be refilled several times.
I wouldn’t mind paying for the Epson brand if I knew I was getting a full tank, and could use it to the last drop!
I wish the settlement included a date for expiration of the patent; similar to what drug companies have, so “generics” can be manufactured.
Has anyone tried to refill an Epson tank at home, using the chip re-setter you can buy on Ebay?
I refill HP tanks with a home refill kit. The refill kit I find most reliable is the Office Depot brand of ink; because it has never failed to be recognized by the printer, and the ink is identical to the brand name - GUARANTEED, or you get a full refund for the ink.
Too bad they don’t have the Epson refill kit yet.
One post-er said something about bubbles in the ink, but that can be solved by shaking the Epson cartridge vigorously before installing it. It drives the bubbles to the top of the tank; and we all know how much empty space comes with each tank, lol!
Any luck on redeeming the settlement credit at the E-store? Maybe they will have a class- action, against the unfulfilled class action settlement; if you know what I mean. That should be worth at least another $45 worth of ink!

This settlement just seems silly. I have the piece of crap printer that requires the ink, and now I have credit for the ink I supposedly need to make it work. Well as most of us know, these printers usually work ok until you need to replace the ink. Then the print head clogs and you’re screwed - new ink or not. I’ll never buy an Epson - thank God I got this one as a gift. Garbage!

I still like epson better than lexmark and a lot of HP rather replace 1 color cartrige than a combo cartrige that cost 45 bucks a crack, all the printers come from foreign countries even the cartriges must be a hell of a good profit for retailers.

This is very frustrating. The case was settled many months ago and the first thing that the lawyers did was to get their money within days of the settlement. It seems like we (the injured parties) are not really any concern to them. I am starting to wonder if we will ever get a notification.

I have a r300. What a joke!
The printer worked beautifully until it came time to replace the cartridges. As the new cartridges went in, that color would no longer print, even tough the ink tank was obviously full. I got down to one color working and when that last original tank went dry, the printer ceased to print…with all cartridges new, full, and Epson branded.
My theory is that Epson subtly changed the design of this cartridge, and it won’t allow the print head closure mechanism to fully snap the cartridges down. Why else would only the originals continue working???
I now have a fairly new Epson R300 that won’t print with new cartridges.
I will never buy again from this company. I will never use the stupid settlement rebate. Why? To buy more cartridges that won’t work?
If this company won’t own up to this disaster, They’ll obviously have no compunction to lie about any aspect of their business that directly affects the bottom line.
It’s very sad that the R300, with all it seemed to have going for it, may be the most expensive ‘one time use’ disposable printer in history.
Do not buy this piece of trash.

I just bought 4 new Epson ink packs and I’ve cleaned the printer heads more than 4 times. Still can’t get all the colors to work right. All I get is magenta. Getting very angry about this whole ink situation! I wish I never bought Epson!

“perfection” 4180 Photo scanner. Both quit in the same week. The printer said “error
service required printer copmponents are at end of service life see printer manual for details”–no details in manual.Called Epson service said it would cost $100 to fix it.

I bought this rubbish in 2004…i print a page once a month but this little fella empties itself in a few months.I went to print last week..no black…2 days later returned..installed black but no yellow had run out even though no one could use the machine…I bought the yellow and the light cyan had run out hahahahah. €17 per cartridge what a load of rubbish.It has a foam insert inside where the head “parks” and this is soaked in ink

quality goes with the price..the quality of photos epson printers
creats are superior than lab processed photos.it is because
of the technology behind durabrite inks compared to typical
dye based inks.i’ve researched on this type of mechanism and
it aint as bad as most consumers thought.

My Epson PictureMate has been good to me. I had some trouble with their rebate when I first bought it, because I sent it in late. When I complained that I felt cheated due to missing the deadline, which always feels like a way for companies to offer something that they try not to pay out, they agreed to send me an equivalent value in printer supplies, which was very reasonable. The problem with this settlement benefit has been the early notification followed by over a year of waiting for the conclusion. That’s pretty ridiculous, but how much is up to the courts or Epson, I have no clue. I can’t wait to get my $45 towards more Epson stuff, though

I bought my printers in April of last year. Since I don’t print too often, I didn’t start having problems unit February of this year and subsequently hadn’t heard about any of this until then. From everything I’ve read, I would have needed to register by November 13 at the latest to even receive a $45 coupon. Does anyone know of a way around this, or am I simply out of luck? Any suggestions or recommendations would be most appreciated. Thanks.

We have had 2 Epson printers in the past both ended up in the bin due to new cartridges every 2 weeks even though printer was not used.
We thought that maybe Epson had sorted this out by now and tried the RX420 as we were looking at an all in one and guess what we were wrong 3 months old and 3 sets of replaced inks and all we did was print 16 photos 4 to an A4 page thats 4 A4 pages then blue would not print had to clean heads 3 times guess what red ran out new set of cartridges at £29.00 and now wont work at all its now in the bin wont send back under warrenty its just not worth it.
Now got my trusty HP 930c which I have had for 6 years back out and bought a scanner.
I agree that something should be done about Epson

Too right something ought to be done about the thieving ba5tards at Epson! We made the mistake of buying ten R300s and R320s and trashing four of them. Needless to say we’ll never buy another Epson product so long as we all live and whilst we’re about it, that goes for Epson’s sister company too - Seiko.

I received 2 $45 credits I can’t combine them to buy a printer. which would mean i’d have to buy ink for the printer. I can only use one at a time for one item if item sells for $12 the rest of credit is forfitted.
So what i’m doing is buying as close to the $45 as I can, and swearing to never buy an epson product again. I’ll use Ink from other sourses and refill my own cartridge.

.I elected to take the $25.00 checks(3) and the (3) $20.00 CREDITS expecting to be able to use them to buy a reconditioned RX Stylus 5800.Boy did I get a kick in the head when they told me I could NOT combine them because their computers were not setup to enter more than one code. A sorry a– excuse if you ask me. I then tried to reach JOHN LANG, Epsom’s CEO.I was then passed off to a Margret Caldwell of Corporate Customer Relations. She turned out to be a Brick Wall even after I read the portion of the decision that says they are store CREDITS Not discounts or rebates. Nowhere in the decision does it state they must be used separately. Lets all flood the CEO with FAXES.

The Epson On-Line Store, which is the only place the code is valid under the Court-approved settlement, never had the functionality to accept multiple codes for one order, so these code are not combinable. This is the only way for us to verify that the codes are being used by the lawful settlement recipients. We cannot process these credits any other way.

This is totally unacceptable, I have 9 separate stubs with 7 payments for myself and two payments for my Wife Therefore, any business should do the right thing and have customer service handle this transaction. I can send these lawful settlement coupons to your customer service department with my order so these coupons, can be placed on one order. Any other company would handle it this way. Thank you. I believe, the Better Business Bureau will agree with me and at their discretion leave you notice of bad and unacceptable business practices. Epson America,you have great products, but you should treat your customers fairly.

In phone calls to epson they will not allow more than one discount credit per transaction. and their final resolution is the same. So as consumer our only resolution is to complain to the better business bureau.

Again, the codes were provided through the Court-approved settlement. Epson will not make an exception to the way the codes are to be processed. >>>
If they get enough complaints other comsumers well see our point of view.

I got the postcard saying my code was active but I never receieved a code. Who do I contact?

Like some other people, I received a postcard telling me that the codes would be activated as of June 20, 2007. Well that’s all fine and dandy, but they don’t supply a code. I’ve called all over from the Claims Administrator to Epson, and back again, and back again, etc. etc. ad naseum. They are just running me in circles. Add my name to the list that won’t buy Epson again. Thanks to Umberto (#54) for supplying the name and phone number of the CEO. I agree with him - EVERYBODY CALL, OVER AND OVER.

…… and the fight goes on. I have an Epson RX680. Epson sued the Chinese who were making cheaper ink cartridges for the printer, and they are just now coming back available. The problem is, when you use the “comparable” inks, because of Epson technology, you have to replace ALL the ink cartridges with the comparables, not just the ONE you are out of. Good ol’ technology. Screwed again by Epson.
